COX RADIO RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. The 99.5 KISS Halloween Costume Photo Contest is open to U.S. residents living in the San Antonio Metropolitan area and surrounding counties and 21 years or older at the time of. Employees of 99.5 KISS, Cox Radio Inc., Cox Enterprises, Coors Light, any other San Antonio Radio Stations Employees and each of [its/their] respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees, are not eligible. Winners can pick up their prize(s) at the Cox Radio offices, located at 8122 Datapoint Drive, Suite 600, San Antonio, TX 78229.
3. Entry. The Contest will begin at 12am on October 19th, 2009 and all entries must be received by 11:59pm on November 15th, 2009.
4. Enter by visiting the 99.5 KISS Halloween Costume Photo official registration page located at the URL: http://coxradio.upickem.net/engine/Welcome.aspx?contestid=10946 and completing all of the required information and following all instructions.
One (1) entry per person may register.
99.5 KISS will not be responsible for incomplete, lost, late, [insert "postage-due," if mail entry is permitted] misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or 99.5 KISS. In the event of a dispute, all online entries will be deemed to have been submitted by the holder of the email account identified in the entry materials. For theses purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the holder of an email account shall be determined by 99.5 KISS in its sole discretion, and 99.5 KISS reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. All entries become the property of 99.5 KISS, and none will be returned.
4. Prizes and Odds. The person who submitted the photo with the most votes as of Sunday, November 15th at 11:59pm will receive a pair of tickets to see the Spurs take on the Utah Jazz on Thursday, November 19th and a family four-pack of Regal Cinemas movie passes. If there is a tie, one winner will be selected in a random drawing from among all eligible entries. (approximate retail value $100)
Odds of winning depend on the number of eligible entries received. Contest may be presented in multiple presentations and in other media, and the odds of winning may depend on the number of eligible participants who enter the contest through such multiple presentations.
5. Winner Notification and Acceptance. Winners will be notified by telephone on or about November 16th. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability, and 99.5 KISS reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Except where prohibited, participation in the contest constitutes entrant's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. 6. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. 99.5 KISS reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by 99.5 KISS. In the event the Contest is compromised by a virus, non-authorized human intervention,"] tampering or other causes beyond the reasonable control of 99.5 KISS, which corrupts or impairs the administration, security, fairness or proper operation of the Contest, 99.5 KISS reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, 99.5 KISS reserves the right to award prizes based on the entries received before the termination date.
7. Limitations of Liability. By entering the Contest, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
8. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and 99.5 KISS, shall be governed by, and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of Texas, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Texas. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
9. General Release. By entering the Contest, contestants release 99.5 KISS, Cox Radio Inc., Cox Enterprises, Coors Light, any other San Antonio Radio Stations Employees, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
10. Sponsor. The 99.5 KISS Halloween Costume Photo Contest is sponsored by 99.5 KISS whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. 99.5 KISS will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest. You must be 21 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If SecondStreetMedia cannot find an eligible winner for the prize, that prize will not be awarded.

Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
SecondStreetMedia reserves the right to substitute any prize with another prize of equal or greater value.
SecondStreetMedia reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of SecondStreetMedia, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to SecondStreetMedia the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
SecondStreetMedia reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or SecondStreetMedia. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and SecondStreetMedia are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
